1. Agreement to these Terms

These Terms of Service ("Terms") are a legally binding agreement between you and the operator of Train The Brain ("Train The Brain", "we", "us", "our") — the website at trainthebrain.app and its related sub-domains, apps, widgets and services (together, the "Service").

By accessing or using the Service, creating an account, or purchasing a subscription or gift code, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

If you are entering into these Terms on behalf of a company or other organisation, you represent that you have authority to bind that entity.

2. How to contact us

For any question about these Terms or the Service, contact us at admin@wastore.app. This is the address for all notices to us under these Terms.

3. Eligibility and age

  • You must be at least 16 years old (or the age required for consent to online services in your country, if higher) to create an account or make a purchase. If you are between 13 and that age, you may only use the Service and hold an account with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf.
  • Some games are labelled as suitable for children. These are intended for use by a child under the supervision of a parent, guardian or teacher. Accounts, subscriptions and payments must be set up by an adult.
  • You must not use the Service if you are barred from doing so under the laws of your country or any applicable sanctions.
  • One person may not maintain more than one account, and accounts may not be shared, sold or transferred.

4. Your account

  • You can create an account with an email and password or through a third-party sign-in (for example Google). You are responsible for keeping your credentials secure and for all activity under your account.
  • You agree to provide accurate information and to keep it up to date. Choosing a display name that is offensive, misleading or infringes someone's rights is not permitted, and we may change or remove it.
  • Tell us promptly at admin@wastore.app if you believe your account has been accessed without authorisation.
  • You may delete your account at any time. We may retain limited information as described in the Privacy Policy or as required by law (for example, transaction records).

5. Licence to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial use. All rights not expressly granted are reserved.

6. Free and premium plans

Most of the Service is available free of charge and supported by advertising. A paid "PRO" / "Premium" plan removes advertising and unlocks additional features (for example detailed score history, performance analytics, the cognitive profile and leaderboards). The specific features included in each plan are described on the membership page and may change over time.

7. Subscriptions, billing and automatic renewal

7.1 Plans, prices and taxes

Premium is offered as a monthly subscription, an annual subscription, or a one-time lifetime purchase. Prices are shown on the membership page before you buy and may vary by country and currency. Prices are inclusive of applicable taxes unless stated otherwise; where tax is added, it is shown before you confirm.

7.2 Payment and authorisation

Payments are processed by Stripe. By subscribing, you authorise us and Stripe to charge your chosen payment method for the initial term and, for subscriptions, for each renewal term, plus applicable taxes, until you cancel. You are responsible for keeping your payment details valid and current.

7.3 Automatic renewal — please read

Your monthly or annual subscription renews automatically at the end of each billing period at the then-current price for that plan, and your payment method is charged on or around the renewal date, until you cancel. A monthly plan renews every month; an annual plan renews every 12 months. The lifetime plan is a single payment and does not renew.

Your current plan, price and next renewal date are always shown in the Stripe billing portal, which you can open any time from Profile → Manage subscription. Where the law requires advance notice of a renewal, we will provide it.

7.4 How to cancel

You can cancel at any time from Profile → Manage subscription, which opens the Stripe billing portal, or by emailing admin@wastore.app. Cancellation stops future renewals. It takes effect at the end of the current billing period — you keep Premium access until then, and you are not charged again. Except where the law requires otherwise, we do not provide partial refunds for the remainder of a period after a renewal has been charged.

7.5 Price changes

We may change subscription prices. We will give at least 30 days' notice of a change before it applies to your renewal, together with how to cancel. If you do not want to pay the new price, cancel before it takes effect; continuing after that date means you accept the new price.

7.6 Free trials and introductory pricing

If we offer a free trial or a reduced introductory price, it converts to the standard recurring price automatically at the end of the trial or introductory period unless you cancel beforehand. The terms and end date are shown when you sign up and, for as long as the trial or introductory period is active, in the billing portal.

7.7 Lifetime plan

"Lifetime" means for as long as we continue to operate the Service, not the lifetime of any individual. It is a one-time payment with no recurring charge. If we permanently discontinue the Service within 24 months of your purchase, we will provide a pro-rata refund of the lifetime price for the unused portion of that 24-month period. After 24 months, no refund is due. This does not affect any refund you are entitled to under mandatory law.

7.8 Failed payments

If a renewal payment fails, Stripe may retry it over a short period. If payment cannot be collected, your Premium access may be paused or downgraded to the free plan without notice. You can restore access by updating your payment method.

8. Refunds and your right to cancel

8.1 Consumers in the EU, EEA and UK — right of withdrawal

If you are a consumer in the EU, EEA or UK, you normally have 14 days from purchase to withdraw from a distance contract without giving a reason. However, by starting to use Premium (digital content and services) during that period, you expressly request that we begin immediately and acknowledge that you lose the right of withdrawal once the service has been fully performed, and that for digital content you lose it once access begins. Where the right still applies, contact admin@wastore.app; we will refund within 14 days of being informed, less any amount reflecting use already made where permitted.

8.2 Voluntary refund policy

Outside any statutory right, we offer a goodwill refund on your first Premium purchase if you contact us within 14 days of that purchase and have not made substantial use of paid features. Renewal charges and any later purchases are non-refundable except where the law requires otherwise.

8.3 Nothing here removes your legal rights

Mandatory consumer-protection rights in your country of residence — including any statutory guarantee that the Service is as described and of satisfactory quality — apply in addition to this section and are not limited by it.

9. Gift codes and vouchers

  • Gift codes grant the plan stated at the time of purchase (for example lifetime Premium) when redeemed on an account.
  • Codes are single-use, have no cash value, cannot be exchanged for cash, and cannot be resold or combined unless we say so. Gift codes do not expire.
  • The purchaser's statutory withdrawal rights (section 8.1) apply to the purchase of the code until it has been redeemed.
  • We may void codes obtained through error, fraud or in breach of these Terms.

10. Acceptable use

You agree not to:

  • use bots, scripts, automation, macros or any other means to play games, generate scores, or interact with the Service other than through the interface we provide;
  • cheat, manipulate or falsify scores, streaks, leaderboards, the IQ test or the cognitive profile;
  • copy, scrape, harvest or systematically download content or data from the Service;
  • reverse engineer, decompile or attempt to extract source code, except to the extent this restriction is prohibited by law;
  • circumvent, disable or interfere with advertising, paywalls, rate limits, security or access controls;
  • resell, sublicense, rent or commercially exploit the Service or any part of it;
  • probe, scan or test the vulnerability of the Service, or breach its security, without our prior written permission;
  • upload malware, or use the Service to infringe intellectual property, defame, harass, or break any law;
  • impose an unreasonable load on our infrastructure or disrupt other users' enjoyment of the Service.

11. Leaderboards and fair play

Where you take part in leaderboards or global rankings, a display name and your scores are shown publicly. We may review, adjust, reset or remove scores; disqualify or ban accounts that we reasonably believe have cheated; and change or discontinue leaderboards at any time.

12. Your content

You may submit content such as game suggestions, feedback and a display name ("User Content"). You keep any rights you have in your User Content, and you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to use, store, reproduce, adapt and display it for the purpose of operating, improving and promoting the Service. For ideas and suggestions specifically, you agree we may use them without obligation or compensation to you.

You are responsible for your User Content and confirm it does not infringe anyone's rights or break any law. We may remove User Content at our discretion.

13. Intellectual property

The Service, including the games, software, text, graphics, design, the "Train The Brain" name and logo, and all related intellectual property, is owned by us or our licensors and is protected by law. Except for the licence in section 5, nothing in these Terms transfers any intellectual property rights to you.

14. Third-party services and advertising

  • The Service relies on third parties including Stripe (payments), Google / Firebase (authentication and data storage), an advertising partner and analytics providers. Their handling of data is described in our Privacy Policy.
  • The free plan is supported by third-party advertising. We do not control and are not responsible for the content of ads or of any third-party sites they link to. Premium removes advertising served by us.
  • Your use of a third-party service through the Service may also be subject to that third party's own terms.

15. No medical or professional advice

The games, the "IQ test", the "cognitive profile", percentile scores, "brain age"-style outputs and any comparisons are provided for education, self-tracking and entertainment only. They are not a clinical, diagnostic, psychometric or professionally administered assessment, and they are not a substitute for advice from a doctor, psychologist, educator or other qualified professional. Do not rely on results from the Service to make medical, psychological, educational, financial or employment decisions. If you have concerns about your cognitive health, speak to a qualified professional.

16. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free or secure, that defects will be corrected, that scores or analytics are accurate, or that using it will produce any particular improvement in your abilities. We may change, suspend or withdraw any part of the Service.

Nothing in this section affects warranties or guarantees that cannot be excluded under the law that applies to you as a consumer.

17. Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded under applicable law (including your non-excludable statutory consumer rights).

Subject to that, and to the fullest extent permitted by law:

  • we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or opportunity; and
  • our total liability to you arising out of or relating to the Service and these Terms is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, and (b) USD 50 (or its equivalent in your local currency).

If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill, but we are not responsible for loss or damage that is not foreseeable.

18. Indemnity

If you use the Service other than as a consumer, you agree to indemnify us against claims, losses and reasonable costs arising from your breach of these Terms, your misuse of the Service, or your User Content. If you are a consumer, you are responsible only for losses we suffer that are a foreseeable result of your own breach of these Terms.

19. Suspension and termination

  • You may stop using the Service and delete your account at any time. Cancelling a subscription is covered by section 7.4.
  • We may suspend or terminate your access, with or without notice, if you materially or repeatedly breach these Terms, if we reasonably suspect fraud or abuse, or if we are required to by law. Where it is reasonable to do so, we will give you notice and an opportunity to fix the problem.
  • If we terminate your paid plan other than for your breach, we will refund any prepaid, unused portion.
  • Sections that by their nature should survive termination (including sections 12, 13, 15–18 and 20–22) continue to apply.

20. Changes to the Service and these Terms

We may update the Service and these Terms from time to time — for example to reflect new features, legal requirements or security needs. If a change to these Terms is material and affects you, we will post the updated Terms on this page with a new "last updated" date a reasonable time before the change takes effect. Changes that are required by law or that do not reduce your rights may take effect immediately. Please check this page periodically.

If you continue to use the Service after a change takes effect, you accept the updated Terms. If you do not accept them, you should stop using the Service and, if you have a subscription, cancel it; you may be entitled to a refund of any prepaid, unused amount where the change materially disadvantages you.

21. Governing law and disputes

These Terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by the laws of the country in which the operator of the Service is established, without regard to its conflict-of-law rules. The courts of that country have jurisdiction to settle any such dispute.

If you are a consumer, the previous paragraph does not deprive you of the protection of the mandatory consumer-protection laws of your country of residence, and you may bring proceedings in respect of these Terms in the courts of that country. Nothing in these Terms limits any right you have to bring proceedings in a small-claims or equivalent court.

Before starting formal proceedings, please contact us at admin@wastore.app so we can try to resolve the matter informally. We do not require you to submit to arbitration and these Terms contain no class-action waiver.

22. Regional consumer notices

EU / EEA and UK consumers

  • Your statutory rights, including the right of withdrawal in section 8.1, are not affected by these Terms.
  • The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr. We are not obliged to use, and do not currently commit to using, an alternative dispute resolution body, but you remain free to use the platform above.

California residents

  • Automatic renewal disclosure. Paid subscriptions continue and renew automatically as described in section 7.3 until cancelled. You may cancel at any time as described in section 7.4, effective at the end of the current billing period.
  • Under California Civil Code §1789.3, you may report a complaint to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

23. General terms

  • Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service and replace any earlier agreements on that subject.
  • Severability. If any provision is found unenforceable, the rest continues in effect.
  • No waiver. If we do not enforce a right, that is not a waiver of it.
  • Assignment. You may not transfer your rights under these Terms. We may transfer ours to an affiliate or in connection with a merger, acquisition or sale of assets, provided your rights are not reduced.
  • Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control.
  • Notices. We give notice to you by posting it on the Service. You give notice to us at admin@wastore.app.
  • Language. These Terms are provided in English. Any translation is for convenience only; the English version governs to the extent permitted by law.
